How is a workers' compensation paid?

Workers' compensation attorneys are not paid by the State of Oregon.  They are not paid by the worker.  Yet, they are not charitable institutions who require no pay, either.  Instead, workers' compensation attorneys are paid by the insurer or the self-insured employer, but only in certain circumstances outlined by law.  On denied claims, the attorney is paid if he prevails in helping the worker get the denial reversed.  In these cases the insurance company or self-insured employer pays the attorney's fee.  The most common way that workers' compensation attorneys are paid is if they obtain the worker a monetary benefit which the worker could not have obtained without the attorney's help.  In these cases, the attorney receives a percentage of that recovery.  Sometimes this is as low as 10%, and sometimes 25%, depending on the nature of the benefit obtained for the worker.
